Seems contrary to the 4th amendment.

3.3k

u/deadpoolfool400 4h ago

It is. You're not obligated to show identification if you don't want to. They're also not allowed to stop you for violations that are not under their jurisdiction (immigration).

1.5k

u/inquisitorthreefive 4h ago edited 3h ago

It's important to note here that they ARE NOT just asking for ID. They're asking for proof of citizenship. In the US, the only documents that will do that are a birth certificate, naturalization documents or a passport. According to the administration, 2 of those 3 are questionable.

Edit: Forgot about Enhanced Driver's Licences. Those do prove citizenship but are only available in a few states.

952

u/Pushabutton1972 4h ago

That's why the correct answer is to tell them to fuck off since they have no jurisdiction or legal basis to harass people. Masked men harassing people is illegal.

713

u/ObviousAnswerGuy 4h ago

it is illegal, but that doesnt stop them from kidnapping and detaining you

833

u/angiosperms- 4h ago

Showing proof of citizenship also doesn't stop them from kidnapping and detaining you so 🤷‍♀️

322

u/ObviousAnswerGuy 4h ago

exactly. We are in a full blown dictatorship.

186

u/angiosperms- 4h ago

Compliance is just delaying the inevitable. At least not complying has somewhat of a chance of eventually stopping this. ICE are very emboldened because so far they get to do everything they want with no consequences. If anyone actually does push back they usually back down real quick.

57

u/avocadoflatz 3h ago

Everyone that feels they can manage going for the ride and being detained for several days or even weeks without emerging to their lives in shambles should probably be as uncooperative as they feel comfortable being - if nothing else it keeps a handful of ICE agents from being able to harass other less fortunate individuals.

The risk for US citizens engaging in this sort of behavior can still be pretty high though - broken ribs, torn shoulders, broken or missing teeth …

108

u/angiosperms- 3h ago

You can get shot in the face or your baby can get teargassed for complying so it's time to stop pretending you won't get hurt or killed as long as you comply.

There are also a lot of people who refused and faced no consequences.

Like you do you but it's not like they stop you one time and you're safe. They are going to keep doing it as long as people keep complying and every time your risk of getting beaten/detained/killed increases as they become more emboldened.

They haven't been good at taking no for an answer. Doing this has a good chance of ending up with you face down on the pavement as they arrest you for "resisting". They then take you to a holding cell, keep you there for 4-48 hours while they "consider" charges and make sure you're in whatever stupid face database they're making, then release you miles from where they picked you up because they were never going to file charges and knew that they were breaking the law before they detained you, but they don't care because they personally are never going to face consequences on the off chance you do sue for having your civil rights violated, and the only thing that happened is that you and/or your property were roughed up, traumatized, and your time was wasted while they got paid to role play CoD irl.

They’ve been rejecting the enhanced drivers licenses too.

9

u/AnAcceptableUserName 1h ago edited 46m ago

Yeah it's a bad joke

Submit your birth certificate, social security card, and additional proof of residency to get a state driver's license

Then submit the same documents to get a "Real ID," an object explicitly legislated by the Fed to be a verified national ID

Only to have this administration say the Real ID isn't good enough. "So what should we do?" one might ask.

Well that's easy, just carry your birth certificate and social security card with you everywhere, says Noem. Those same documents you used to get issued the driver's license & Real ID.

But those aren't good enough either so they're gonna take your picture and ask AI, because the AI is infallible

Total circus. Might as well just come out and say "we reserve the right to fuck with anyone we think looks brownish." ...oh wait, they did do that

The ridiculous supreme court ruled that just being non white is suspicion of being an illegal. It sucks but that is how they get around it. https://www.npr.org/2025/09/13/nx-s1-5507125/the-supreme-court-clears-the-way-for-ice-agents-to-treat-race-as-grounds-for-immigration-stops

I don't agree with the ruling obviously but that is how they are justifying it. They also are relying on the fact that Bindi won't prosecute crimes committed by ICE but nothing stops them from being prosecuted once Trump is dead because yeah is an 80 year old obese person with a stressful job.

92

u/Coomb 4h ago

You know what's funny is that Kavanaugh recently filed a concurring opinion in a different case (Trump v. Illinois) where he said basically the opposite of what he had just said in September. It's probably because people started calling the stops based on apparent ethnicity "Kavanaugh stops".

u/adrr 4h ago

The can and will haul you off to detention if you don’t give them any documents. They hauled off a bunch American citizen including native Americans. Supreme Court ruled that appearance can be used for reasonable suspicion. Do you want to get stuck in alligator Alcatraz for a month eating spoiled food and drinking dirty water while sleeping on concrete?

16

u/Neologic29 4h ago

They'll do that if they decide the documents you do decide to give them aren't sufficient. Rights are eroded in this exact way. Too many people either don't know them or don't care to exercise them. Each step is closer to not having them.

250

u/noideaman 4h ago

Kavenaugh stops. You can use ethnicity as one part of the totality of the circumstances for RAS to detain. It’s bs, but that’s what they said.

42

u/Dolthra 4h ago

Also important to note here that "stopped someone because of ethnicity" is different than "stopped someone demanding they show me their papers" by a long shot. One at least has the pretense of legality, the other is blatantly unconstitutional.

57

u/sonic_couth 4h ago

And he didn’t like that they’re being called that. Fuck Supreme Injustice Boofer Kavanaugh

30

u/stonemuzzle 3h ago

He shouldn't have invented a nonsensical excuse to violate civil liberties if he didn't want to get associated with it. Besides, he and the other Republicans on SCOTUS are in far too deep to bother worrying about legacy. They invented magical crime immunity for a felon, after helping the same felon get out of his case for stealing a bunch of documents from the US and trying to hide them.

There's no rewriting that much history in the information age. They can live their lives of luxury until death, but can do nothing about being remembered as traitors long after, since their actions are both a matter of public record, and of massive amounts of reporting and conversations around them.

Then again, even McConnell seems to be trying for some last second redemption, despite being long overdue for a cell, so maybe these ancient people are really so out of touch as to think they can find a way to be remembered as anything but betrayers and failures. They should probably aspire to something more realistic, like spontaneously creating fireballs with their minds.

77

They don’t actually care about that one either, except as a quick single issue vote getter. They will happily restrict gun rights of any real resistance they face.

16

u/ImpulsE69 3h ago

Yep as soon as any real pushback happens, watch them shut down all the gun shops and stop people 'of ethnicity' and check and take, regardless of carry or not. When I was in school it was explained to me that only dictatorial government, particularly communist ones, but also using Nazi Germany as an example, required such paperwork. I remember in the movie Red October when Sean Connery's (Capt Ramius) character is talking about living in the US with Sam Neill's character.

Capt. Vasili Borodin: I will live in Montana. And I will marry a round American woman and raise rabbits, and she will cook them for me. And I will have a pickup truck... maybe even a "recreational vehicle." And drive from state to state. Do they let you do that?

Captain Ramius: I suppose.

Capt. Vasili Borodin: No papers?

Captain Ramius: No papers, state to state.

Capt. Vasili Borodin: Well then, in winter I will live in... Arizona. Actually, I think I will need two wives.

Many of the Stalinist purges from Moscow targeted immigrants without valid paperwork. But the police would just grab almost anyone to meet quota. There are stories of men going outside for a smoke and being arrested and deported to Siberia because they didn’t have their papers on them.

44

u/MommyLovesPot8toes 3h ago

We ARE that country!! The second you say "oh well, I guess we have to carry papers now" is the moment we lose this country. But right now, I say "fuck you, make me." That is the American spirit.

Don't comply in advance. Don't give them one inch without fighting for it.

Do you really think that if the million white people around Minneapolis just decide "no, I'm not carrying my papers", ICE will continue demanding them and arresting people? They don't have the capacity! They are counting on us to rollover and comply because they know they can't make us. Be an American: Be stubborn!

Do NOT carry your citizenship documents with you!

If you really feel the need to carry around something like your passport, carry a paper copy of it ONLY. Not your actual passport and not a picture of it on your phone either. You want to present to ICE your unlocked phone? The last thing you want is ICE to refuse to return your passport or phone until you answer all of their questions to their satisfaction. Carry a paper copy ONLY so that you're in a position to tell them to fuck off and walk away, leaving nothing of value behind. A paper copy has everything they need. They're not out there on the streets with chip readers and passport scanners. This ain't the airport.

You'll never feel more alive as a United States citizen than when you exercise your rights by telling some trumped up thug that your rights don't end when they get pissy.

u/alterom 3h ago

Alternatively: apply for and get a passport card in addition to your passport.

That's an actual ID that proves citizenship (and is accepted at land border crossings).

Keep your passport away from the thugs. And if needs be, let them have the passport card.

73

u/cheese-glitter-treea 2h ago

Ugh.  To get the passport card if you already have the book you have to send you book back in.  so you're without your passport until the process the card and send it all back

Honestly, an argument could be made that it's worse...

Germans in 1933 had no historical precedent to warn them against voting for a party that held such extreme views.

In 2016 and 2024, people had blaring historical warnings going off from within living memory... and they still didn't see the signs that were clearly present at all stages of this iterations rise to power.

Interestingly, in the U.S. criminal justice system, the burden of proof remains on the government.

Furthermore, it's not a crime anywhere in the US to go without identification.

Just little things that are true, at least as of 01/16/2026

imho this looks like a precise strategy to instigate a violent response. It looks like the government really want to ignite a civil war.

47

That is literally the goal

The president of the Heritage Foundation said that the country was “in the process of the second American Revolution, which will remain bloodless if the left allows it to be.”

The second civil war already started

Democrat files articles of impeachment against Noem

The first impeachment article alleges Noem denied Kelly and other members of Congress “oversight of ICE detention facilities,” the congresswoman said at her presser.

Kelly explained the second article, which accuses Noem of violating public trust, by saying Noem “directed DHS agents to arrest people without warrants, use tear gas against citizens, and ignore due process.”

Kelly said Noem frequently says “she’s taking murderers and rapists off our streets, but none of the 614 people arrested during Operation Midway Blitz in Chicago has been charged or convicted of murder or rape.”

On the third impeachment article, which accuses the secretary of self-dealing, Kelly said Noem “abused her power for personal benefit,” and “steered a federal contract to a new firm run by a friend.”

Too bad almost all Republicans in Congress won't grow a pair and actually stand up for the people for once. Vote this November. There is no excuse for apathy and staying home.

This is the sad truth, the same reason Trump supports won't have any issues with this impediment on American rights. They know they're safe because they are loyal.

You ever think about how the people who love police and don't care about brutality also pretty much always have friends or family on the force? They don't love the law, they love how they can get away with breaking the law while other people without an "in" will get in huge trouble.

23

u/Petaris 4h ago

They assume they are safe because they are loyal. I suspect that won't work out for them in the long run.

Not that anyone should feel at ease with this because the men in the 60 minutes report already stated they were sexually assaulted but women especially regardless of race should have alarm bells going off. Let’s face it, during any period like this the men in these type of positions will abuse their role of power for personal gain sexually so it’s only a matter of time before we start hearing about SA victims at the hands of ICE. “I find her attractive, I’ll just ask to see if she’s an American citizen”. I really really hope I’m wrong but it’s not something I’d take lightly.

There's no federal law demanding U.S. citizens carry proof of citizenship when walking or in public spaces.

u/cat4hurricane 54m ago edited 46m ago

Gentle reminder that there is no law stating that US Citizens must carry documents stating their immigration/citizenship status, nor are US Citizens legally required to have them available. U.S. citizens are not required to have their passports/passport cards, SSN, or birth certificates with them.

By complying, you are giving them power they do not legally have. They should not be able to demand proof of citizenship for anyone beyond identified immigrants and those going through the process of obtaining Citizenship (Greencard/asylum seekers, Visa holders etc). They should be identifying people before they grab them/know that who they are talking to is an immigrant, but US Citizens are not legally required to have their documents on them at all times. This is not the Soviet Union or Nazi Germany, the US does not have internal travel documents, and people have the freedom of movement here.

US Citizens are actually uniquely free from the obligation to carry our documents on us at all times. It is entirely legal for ICE/CBP/DHS to ask an immigrant for their legal documents/immigration status and documents at any time. It is not legal to require a US Citizen to produce said documents (Documents stated above) nor is it legal to require US Citizens to state or prove their citizenship status on the spot. Most Americans do not have a passport, and the documents required to prove citizenship are (maybe purposefully?) incredibly flimsy, they're not exactly something that's easy to carry around and keep in pristine condition.

7

u/Plastic-Mode-6848 4h ago

If you’re answering yes to this issue and instructing to just comply- do whatever they ask, then when you go to vote, ICE will be at the polling stations asking for proof you- that’s entirely illegal and a violation of our civil rights under the constitution and bill of rights. Fuck’em!
